- Fee Arrangement
- TJE Inc. Attorneys’ (“TJE”) professional services are rendered to you in accordance with our fee arrangement to be discussed and agreed to before our services will commence.

- Information
- All information regarding your business affairs is privileged and will be kept confidential by TJE at all times, except when it is necessary for us to instruct other advisors, such as advocates, tax practitioners, etc. acting on your behalf, or relates to information that is already in the public domain, or when you instruct us, specifically or by implication, to disclose your information.
- In certain circumstances, TJE might be obligated to give evidence and produce information to the courts or authorities in connection with your affairs.
- Copyright and copies
- Copyright of all work prepared by TJE on your behalf, is the property if TJE, who grants you a non-exclusive right to use such work.
- All information held by TJE belongs to us and we have the right to retain ownership and keep copies of such information and data in as far as provided by the law.
- Indemnification against liability
- In the event of any third party making any claim against TJE for any loss or damage, whether direct, indirect, arising from your mandate with us, whether such loss or damage results in breach of contract, delict, negligence or any other cause, without limitation, and whether your mandate with us is cancelled or not, you hereby indemnify TJE against any such claim, unless it is finally determined that the loss or damage was caused by fraud or wilful misconduct on the part of TJE or any of its employees and/or agents.

- Exclusion of liability
- By mandating TJE, you accept the importance to our work of relevant, accurate and sufficient information being furnished to us by you.
- To this end, TJE shall not be liable for any loss, damage, costs or expense whatsoever and howsoever caused, incurred or sustained by you or arising from a failure to disclose such information to us or from incorrect and/or incomplete information furnished to us by you from misrepresentation.
- Electronic communication
- TJE may correspond and convey documentation to you by electronic means of communication and TJE may receive such communications through electronic means from you.
- By mandating TJE, you accept that the electronic transmission of information on the internet or otherwise, has inherent risks and that such communication may become lost, delayed, intercepted, corrupted or be otherwise altered, rendered incomplete or fail to be delivered.
- TJE shall use its best endeavour to ensure that electronic communications that it sends are free from viruses and any other material that may cause inconvenience or harm to any other computer system and you undertake to do likewise with any electronic communications that you send to us.
- Since electronic transmission of information cannot be guaranteed to be secure or error free, any electronic communication sent by you to us, may be vulnerable to access by unauthorised third parties. TJE will not have any responsibility or liability to you except when it acts in bad faith or wilfully cause errors, omissions, claim or loss arising from or in connection with electronic communications.
- FICA and POPIA
- As an accountable institution, TJE is compliant with the Financial Intelligence Centre Act (“FICA”) and will be required to verify your identity and source of income in terms of this Act. As such, we are required to collect your personal information to verify same.
- TJE is also compliant with the Protection of Personal Information Act (“POPIA”) and have a policy in place to protect your personal information. We require your consent in order to collect and process your information.
