Civil litigation is, amongst others, regulated by the Supreme Courts Act, 10 of 2013 and its accompanying Uniform Rules – Rules Regulating the Conduct of the Proceedings of the Several Provincial and Local Divisions of the High Court in South Africa, as well as the Magistrates’ Court Act 32 of 1944, and the Rules Regulating the Conduct of the Proceedings of the Magistrates’ Courts of South Africa.
In practice, every high court has its own Practice Directive setting out the practical ways of implementing the aforesaid rules in that specific court.
